General Terms and Conditions with Customer Information
1) Scope
1.1 These General Terms and Conditions (“GTC”) of PAINTRAIN (operator of the Frontlet Shop) (hereinafter “Seller”) apply to all contracts for the delivery of goods concluded by a consumer or entrepreneur (hereinafter “Customer”) with the Seller in respect of the goods presented by the Seller in its online shop. The inclusion of the Customer’s own terms and conditions is hereby objected to unless otherwise agreed.
1.2 For contracts regarding the delivery of vouchers, these GTC apply accordingly unless expressly stated otherwise.
1.3 A consumer under these GTC is any natural person who enters into a legal transaction for purposes that are predominantly neither professional nor self‑employed. An entrepreneur under these GTC is a natural or legal person or a legal partnership with capacity, acting in the exercise of their commercial or independent professional activity when concluding a legal transaction.
2) Conclusion of Contract
2.1 The product descriptions in the Seller’s online shop do not constitute binding offers but serve to allow the Customer to submit a binding offer.
2.2 The Customer can submit an offer using the online order form integrated in the Seller’s online shop. After placing the selected goods in the virtual shopping cart and completing the electronic ordering process, clicking the button completing the process constitutes a legally binding contractual offer regarding the goods in the cart. The Customer may also make the offer by email.
2.3 The Seller may accept the Customer’s offer within five days by transmitting a written order confirmation or confirmation in text form (fax or email), whereby the time of receipt by the Customer is decisive; or by delivering the ordered goods, where delivery to the Customer is decisive; or by requesting payment from the Customer after receipt of the order. If multiple options occur, the contract is formed at the point when the first alternative occurs. The acceptance period begins the day after the Customer sends the offer and ends at the end of the fifth day thereafter. If the Seller does not accept the offer within that period, this constitutes a rejection and the Customer is no longer bound by their declaration of intent.
2.4 If the payment method “PayPal Express” is chosen, payment is processed via PayPal (Europe) S.à r.l. et Cie, S.C.A. under PayPal’s terms of use. If the Customer does not have a PayPal account, the terms for payments without an account apply. Choosing “PayPal Express” and clicking the final button also issues a payment order to PayPal. In this case the Seller hereby accepts the Customer’s offer at the moment the Customer initiates the payment via that click.
2.5 If “Amazon Payments” is selected, payment is processed via Amazon Payments Europe s.c.a. under its terms. Clicking the final button issues a payment order to Amazon. The Seller likewise accepts the Customer’s offer at the moment that click initiates payment.
2.6 Upon submission via the Seller’s online order form, the contract text is stored by the Seller after conclusion and sent to the Customer in text form (e.g. email, fax, letter). No further access to the contract text is provided. If the Customer has created an account in the online shop prior to ordering, order data are archived on the Seller’s website and can be accessed by the Customer through their password‑protected account free of charge.
2.7 Before submitting an order via the online form, the Customer can identify input errors by carefully reading the on‑screen information. A technical aid like zooming with the browser may help. Inputs can be corrected using standard keyboard and mouse functions until the final button is clicked.
2.8 The contract is concluded exclusively in the German language.
2.9 Order processing and contact normally take place via email and automated systems. The Customer must ensure that their provided email address is correct and capable of receiving emails from the Seller (and parties commissioned by the Seller), including via SPAM filters.
3) Right of Withdrawal
3.1 Consumers generally have a right of withdrawal.
3.2 Further details on the withdrawal right are provided in the Seller’s cancellation policy.
4) Prices and Payment Terms
4.1 Unless stated otherwise in the product description, prices are total prices including statutory VAT. Any additional delivery and shipping costs are stated separately in product descriptions.
4.2 For deliveries outside the EU, additional costs may arise (e.g. bank transfer fees, exchange rate charges, customs duties) which the Seller is not responsible for and must be borne by the Customer. Such costs may also apply when payment is made from outside the EU even if delivery is within the EU.
4.3 Available payment methods are communicated to the Customer in the Seller’s online shop.
4.4 If prepayment via bank transfer is agreed, payment is due immediately after contract conclusion, unless a later due date has been agreed.
4.5 When using any PayPal payment option, payment is processed via PayPal under its terms of use or the terms for payments without a PayPal account.
4.6 If “SOFORT” is chosen, payment is processed via SOFORT GmbH. The Customer must have activated online banking that supports SOFORT, authenticate during payment, and confirm the payment order. The transaction is executed immediately and the bank account debited.
4.7 If a payment method offered via Shopify Payments is chosen, payment is processed via Stripe Payments Europe Ltd. Stripe may use additional payment services with separate terms. More info is available via Shopify Payments terms.
4.8 If “PayPal Invoice” is selected, the Seller assigns their claim to PayPal. PayPal performs a credit check. If approved, the Customer must pay within 30 days from receipt of goods (unless otherwise specified). Only payment to PayPal discharges the obligation. Seller remains responsible for general customer inquiries.
4.9 If “PayPal Direct Debit” is used, PayPal collects the amount from the Customer’s bank account by SEPA direct debit after advance notice. If the debit fails or is reversed, the Customer bears bank charges if responsible.
4.10 If a Klarna payment method is chosen, payment is handled by Klarna Bank AB under Klarna conditions which are provided in payment information.
5) Delivery and Shipping Terms
5.1 Delivery is by shipment to the address provided by the Customer unless agreed otherwise. The address given during the Seller’s order process applies. If PayPal is used, the address stored in PayPal at payment time is decisive.
5.2 If delivery fails for reasons attributable to the Customer, the Customer bears resulting reasonable costs. This does not apply to initial shipping costs if the Customer validly exercises the right of withdrawal. Return costs follow the return policy under the withdrawal instructions.
5.3 Collection in person is not possible for logistical reasons.
5.4 Vouchers are delivered to the Customer by email.
6) Retention of Title
If the Seller advances delivery before full payment, ownership of the goods remains with the Seller until full payment is received.
7) Warranty for Defects
7.1 Statutory defect liability provisions apply to defective goods.
7.2 The Customer is requested to report visible transport damage to the carrier and inform the Seller. Failure to do so does not affect statutorily or contractually owed rights.
8) Special Conditions for Custom Processing
8.1 If the Seller owes processing of goods to Customer specifications, the Customer must provide all required content (texts, images, graphics) in the Seller’s specified formats, and grant necessary usage rights. The Customer alone is responsible for procurement and rights. The Customer declares they hold all necessary rights and ensures no third‑party rights are infringed.
8.2 The Customer indemnifies the Seller against claims by third parties for infringement arising from the Seller’s proper use of Customer‑provided content, including legal defence costs unless the Customer is not at fault. The Customer must supply full truthful information to enable defence.
8.3 The Seller may refuse processing orders if Customer content violates laws, official prohibitions or good morals — in particular containing unconstitutional, racist, xenophobic, discriminatory, insulting, youth‑endangering or violence‑glorifying content.
9) Redeeming Promotional Vouchers
9.1 Promotional vouchers issued free of charge with a fixed validity period and not for purchase (“promotional vouchers”) can only be redeemed in the Seller’s online shop during the stated period.
9.2 Certain products may be excluded according to voucher terms.
9.3 Promotional vouchers can only be applied before completing the order. No retroactive redemption.
9.4 Only one promotional voucher per order.
9.5 The order value must at least equal the voucher amount; no refund for any remaining balance.
9.6 If voucher value is insufficient, another payment method may be used to cover the difference.
9.7 Voucher credit is not paid out in cash or interest-bearing.
9.8 The voucher is transferable. The Seller may fulfil performance to the holder redeeming it in good faith, except if aware of unauthorized use or incapacity.
10) Gift Voucher Redemption
10.1 Gift vouchers purchasable via the Seller’s online shop can only be redeemed in the online shop unless otherwise indicated.
10.2 Gift vouchers and remaining balances are redeemable until the end of the third year after purchase. Remaining balances are retained until expiry.
10.3 Gift vouchers can only be applied before completing the order. No retroactive redemption.
10.4 Multiple gift vouchers may be used per order.
10.5 Gift vouchers may only be used to purchase goods, not additional gift vouchers.
10.6 If voucher value is insufficient, another payment method may cover the difference.
10.7 Voucher credit is not paid out in cash or interest-bearing.
10.8 The voucher is transferable. The Seller may fulfil performance to the holder redeeming it unless aware of unauthorized use or incapacity.
11) Applicable Law
All legal relations of the parties are governed by the law of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice applies only insofar as mandatory protections of the consumer’s country of residence are not withdrawn.
12) Jurisdiction
If the Customer acts as a merchant, legal entity under public law or public special fund seated in Germany, the exclusive jurisdiction for disputes is the Seller’s place of business. If the Customer has their seat outside Germany, the Seller’s business location is exclusive jurisdiction if the contract or claims relate to commercial or professional activity. The Seller may also bring suit at the Customer’s place of residence.
13) Alternative Dispute Resolution
13.1 The EU Commission provides an online dispute resolution platform: https://ec.europa.eu/consumers/odr
This platform is for resolving disputes from online purchase or service contracts involving consumers.
13.2 The Seller is neither willing nor obliged to participate in dispute resolution before a consumer arbitration board.
